1. Services

Marena Budva Boat Tours provides private boat tours, boat rentals, yacht charters, and related tourism services in Montenegro.

Tour details, routes, durations, stops, and included services may vary depending on the selected package, sea conditions, weather, availability, safety requirements, and captain’s decision.

2. Bookings

A booking is confirmed only when we have accepted the booking and, where required, payment or deposit has been received.

Customers are responsible for providing accurate booking details, including name, contact information, date, time, number of passengers, and any special requests.

If incorrect information is provided, we may not be responsible for missed communication, booking issues, or service delays.

3. Prices and Payment

Prices are shown in EUR unless stated otherwise.

Payment terms may vary depending on the service, booking method, or platform used. Full payment or a deposit may be required to confirm the booking.

If payment is made through a third-party platform, that platform’s payment rules may also apply.

4. Cancellation and Refund Policy

The following cancellation policy applies to bookings made directly with Marena Budva Boat Tours:

Customers may cancel up to 72 hours before departure for a 50% refund.

Cancellations made within 72 hours of departure are non-refundable.

If weather or sea conditions are unsafe, customers may reschedule or receive a full refund.

Refunds may be processed to the original payment method where possible. Processing times may depend on the bank, payment provider, or booking platform.

5. Weather, Sea Conditions, and Safety

All tours are subject to weather, sea conditions, port rules, local regulations, and safety decisions.

Marena Budva Boat Tours, the captain, or the responsible operator may cancel, delay, shorten, change, or reschedule a tour if conditions are unsafe or unsuitable.

The captain’s decision is final in all matters relating to safety, route, swimming stops, docking, and passenger conduct.

6. Route Changes

Routes, stops, swimming locations, caves, islands, beaches, and sightseeing points may be changed due to weather, wind, waves, traffic, safety, port restrictions, or other operational reasons.

We will do our best to provide the booked experience, but exact routes and stops cannot always be guaranteed.

7. Customer Responsibilities

Customers must:

  • Arrive at the agreed meeting point on time;
  • Follow the instructions of the captain and crew;
  • Respect safety rules on board;
  • Avoid behavior that may endanger themselves, other passengers, crew, vessel, or property;
  • Inform us in advance about any important mobility, health, or safety concerns;
  • Take care of their personal belongings.

Customers are responsible for any damage caused by their intentional, reckless, or negligent behavior.

8. Late Arrival and No-Show

Customers should arrive at least 15 minutes before departure.

If a customer is late, the tour may be shortened, rescheduled only if available, or treated as a no-show.

No-shows may be non-refundable.

9. Passenger Safety and Conduct

Passengers must follow all safety instructions given by the captain or crew.

Marena Budva Boat Tours may refuse boarding or end a tour early if a passenger behaves dangerously, aggressively, illegally, or in a way that disrupts the tour or creates a safety risk.

In such cases, no refund may be provided.

10. Alcohol, Swimming, and Personal Risk

Swimming, snorkeling, and entering the sea are done at the customer’s own risk and only when allowed by the captain.

Customers must not swim in unsafe areas or against captain instructions.

Alcohol consumption, where allowed, must be responsible. We may refuse service or restrict participation if a passenger appears unsafe to board or participate.

11. Personal Belongings

Customers are responsible for their personal belongings, including phones, cameras, jewelry, bags, clothing, and other valuables.

Marena Budva Boat Tours is not responsible for loss, theft, or damage to personal belongings unless caused directly by our proven negligence.

12. Photos and Marketing

We may take photos or videos during tours for promotional purposes only where appropriate.

If you do not want to appear in photos or videos, please inform us before the tour.

Customers may share their own photos and videos, but must respect the privacy and rights of other passengers, crew, and third parties.

13. Website Content and Intellectual Property

All text, images, logos, designs, graphics, website content, and branding used by Marena Budva Boat Tours are protected by copyright, trademark, and intellectual property laws unless otherwise stated.

You may not copy, reproduce, distribute, modify, or use our website content for commercial purposes without our prior written permission.

14. Third-Party Links and Services

Our website may contain links to third-party websites, booking platforms, maps, payment processors, or social media pages.

We are not responsible for third-party websites, their content, policies, payments, or services.

15. Limitation of Liability

Marena Budva Boat Tours will make reasonable efforts to provide safe and professional services.

To the maximum extent allowed by law, we are not liable for indirect losses, missed travel plans, loss of enjoyment, weather disruption, sea condition changes, third-party failures, or circumstances outside our reasonable control.

Nothing in these Terms excludes liability where it cannot legally be excluded.

16. Force Majeure

We are not responsible for failure or delay caused by events outside our reasonable control, including but not limited to severe weather, unsafe sea conditions, port restrictions, mechanical issues, emergency situations, government actions, strikes, natural events, or other unexpected circumstances.

17. Governing Law and Dispute Resolution

These Terms & Conditions are governed by the laws of Montenegro.

Any dispute should first be resolved amicably by contacting us directly.

If a dispute cannot be resolved amicably, it may be submitted to the competent court in Montenegro.

18. Changes to These Terms

We may update these Terms & Conditions from time to time. Updated terms will be posted on our website with the revised date.
